Another male student is standing up for his due process rights after a sexual assault claim lodged against him has been flubbed by a campus kangaroo court.

A student on suspension from San Diego State University has sued the school over the way it is handling an investigation against him for sexual misconduct.
Attorney Domenic Lombardo, who is representing student Francisco Sousa, said his clients has been denied due process and is not even sure about the specifics of the accusations against him.
Sousa, an international transfer student from Portugal, was arrested Dec. 9 and charged with false imprisonment and forcible oral copulation of a female SDSU student. The charges were later dropped, but he remains suspended and has since enrolled in another school. …
“They have a court that only a kangaroo would love,” Lombardo said.
No hearing to consider expelling Sousa has been scheduled, but Lombardo said he wants the university to turn over evidence against his client so he can prepare his defense if the school does hold the hearing.
“We’re acting before they make that determination so we can exercise our right to defend Francisco with a complete understanding of the accusations,” Lombardo said. “We’re got hundreds of years of jurisdiction arguing against such lapses of due process.”
Lombardo said Sousa has no prior legal problems, is from a good family and is adamant about his innocence.
