Alabama court blocks ban on illegal immigrant enrollment

The U.S. District Court in Birmingham has ruled most of Alabama’s strict new immigration policy will be enforced — but the section that prohibits the higher education enrollment of illegal immigrants has been blocked.

The immigration law now:

  • Allows law enforcement to stop and detain people suspected of being in the country illegally
  • Requires schools to check the citizenship status of children
  • Makes it a felony for illegal aliens to apply for government licenses (license plates, driver’s licenses, business, etc.)
  • Provides non-criminal sanctions for businesses that knowingly hire illegal aliens.

One of the few provisions blocked by the judge, Sharon Blackburn, was the provision that barred illegal immigrants from enrolling in public universities. Other measures blocked include $500 fines for hiring day laborers on the street.

Last month, when Blackburn temporarily blocked the entire law from going into effect, she was critical of the requirement to examine the immigration status of students, asking if the state was creat­ing a disparate classification of students based on national origin.
